Terms and Conditions

Developed new Terms and Conditions to reduce risk and offer better protection to our client.
Problem

Quoting on a residential refurbishment project in North Sydney for a building manger, our client Stafford Brothers, an air conditioning contractor specialising in commercial and residential building projects, was concerned their quotation didn’t offer them enough protection if a customer withheld payment. 

Solution

Kingsbridge Consulting was commissioned to review the quote and provide greater clarity on payment terms and protection in the event of late or non-payment. 

Result

After reviewing the project requirements, Kingsbridge Consulting discussed the potential issues with Stafford Brothers. New Terms and Conditions were developed for Stafford Brothers’ commercial and residential clients to reduce risk and offer better protection.

Claims

Payment Claim Management to ensure the client was paid in full and on time
Problem

Submitting Payment Claims on time and following the builder’s requirements. Due to increased workload, Innerspace needed assistance submitting compliant Payment Claims to the builder, including the provision of correct paperwork in the valid format for the project. 

Solution

Payment Claim management ensuring that cash flow was maximised. Kingsbridge Consulting prepared all Payment Claims for the duration of the project. Before being submitted to the builder, this included a review with the Innerspace Director. We also spoke to the builder’s Project Manager to ensure Innerspace was paid all amounts due and on time each month. 

Result

Through careful management, including negotiating with the builder to reduce short payments, Innerspace’s cash flow was maintained throughout the project. We also kept the relationship with the builder amicable and professional, leading to the successful completion of the project.

Contract Reviews

Contract Review to protect our clients’ interests without coming across as obstructive.
Problem

Our client, Stafford Brothers, was awarded the mechanical works on a high-end office fit out project in Alexandria for a large commercial builder. However, before commencing the project they requested help understanding sand re-writing the contract, especially clauses they identified that could cause potential issues during the project. 

Solution

Kingsbridge Consulting reviewed the contract, providing a list of items that Stafford Brothers should not agree to. In addition, we provided a list of questions they should ask of the builder. The review included suggested wording that protected our clients’ interests without coming across as obstructive. 

Result

After issuing a markup of suggested amendments to the contract, taking out or changing items that would have put Stafford Brothers at risk, the builder agreed to the amendments, and Stafford Brothers were able to complete the project with confidence. 

Contract Review to ensure the client was able to sign and fulfill all contract requirements
Problem

The client needed help reviewing a subcontract agreement and providing compliant safety paperwork. Our client, Innerspace Projects, was engaged to carry out the plasterboard package for an office fit-out for a prominent nationwide commercial builder, a new client.

They were concerned that the contract the builder sent them may have included too risky clauses for Innerspace to agree to. Kingsbridge Consulting was engaged to review the agreement to ensure Innerspace understood and was confident in signing.

Solution

Contract review focusing on the Subcontract Agreement  and the Scope of Works and a review of safety documentation. Kingsbridge held a meeting with Innerspace’s Director to fully understand the company’s capabilities, the project, and the builder’s requirements. We provided a detailed review of the Scope of Works and Contract, highlighting all potential items that may have led to unnecessary risk and cost Innerspace time and money. In addition to the contract review, we also reviewed Innerspace’s safety paperwork to ensure compliance with the builder’s safety requirements. 

Result

After reviewing the suncontract agreement, our client made any necessary adjustments and was able to sign and fulfill all contract requirements. Our review of safety documentation also saved Innerspace valuable time, resulting in the builder providing approval for works to start onsite.
